WHAT IS A WORK PERMIT?

A work permit is a document confirming the approval for the employment of foreign workers in an enterprise or organization.

CONDITIONS FOR OBTAINING A WORK PERMIT IN VIETNAM

To be granted a Work Permit, a foreigner needs to meet the following conditions:

• Employees with professional qualifications, work experience, and skills
• A health certificate is required when applying for a work permit, then the employee must meet the health conditions.
• No history of violations in Vietnam and a clean record in foreign countries.
• Foreign workers must belong to the categories of experts, managers holding director positions in the company, and high-tech workers.
• For enterprises employing workers, written consent is required to employ foreign workers.

The manager or executive director of the company must have:

• The decision to appoint positions in the company
• Certificate of experience of at least 3 years in a position equivalent to the position that the foreign worker is expected to work in Vietnam

In case of being an expert, it is required to have:

• University degree or higher
• Certificate of experience of at least 3 years or 5 years working in a position equivalent to the job that the foreign worker is expected to work at the company in Vietnam, and is consular legalized.

Technical labor:

• At least 1 year of training certificate in technical or equivalent discipline is required.
• Certificate of experience of at least 03 years or 5 years in the training major or in an equivalent position, consular legalized.

PROCEDURES FOR OBTAINING A WORK PERMIT FOR FOREIGNERS

• Step 1: Before 30 days from the date of employment, the enterprise submits an application for approval of the demand to employ foreign workers.
• Step 2: Receive written approval of the need to use foreign workers after the application is approved.
