Warning letters are usually sent within 3 to 5 working days once the evidence is complete. Administrative and court timelines depend on the competent authority and the nature of the case.

a) Can I take action without a registration certificate?
For trademarks, designs and patents, rights arise only upon registration, except for well-known marks. For copyright, rights arise upon creation, but evidence of ownership is needed.
b) Administrative action or a lawsuit?
Administrative action is fast and suited to stopping the infringement and seizing goods. A lawsuit suits clients seeking damages. 7S Law recommends a route based on the objectives and the evidence.
c) How are infringing listings on e-commerce platforms handled?
The amended Law on Intellectual Property 2025 strengthens the responsibility of digital platforms and intermediary service providers. 7S Law sends takedown requests with proof of rights and works with authorities when needed.
d) What are the maximum administrative fines?
Fines depend on the act and the value of the infringing goods under Decree No. 99/2013/ND-CP as amended, most recently by Decree No. 186/2026/ND-CP. Infringers may also face remedial measures such as destruction of goods or domain name recovery.
